Our Services are designed to provide exceptional care and a personalized experience for you and your pet. Below is an overview of the Services we offer. All Services are subject to National Bark’s related policy for each service, which can be found on our website www.nationalbark.com.

  • Dog Boarding: We provide a welcoming and professional environment for your dog, including feeding, exercise, and monitoring. You are responsible for providing necessary supplies (e.g., food, medications, favorite toys) as outlined in our policies and procedures unless otherwise agreed to with National Bark and for abiding by the responsibilities detailed in these Terms and our policies and procedures. Late pick-ups may result in additional fees.
  • Grooming: Our grooming services include bathing, nail trimming, and breed-specific styling. You must ensure your dog is manageable and healthy for grooming. Aggressive or unsafe behavior may result in refusal of service. Arrive on time and disclose any allergies, sensitivities, or special grooming requirements.
  • Training: We offer tailored training programs to address behavioral challenges and improve obedience. While we provide expert guidance, your active participation and follow-through are essential for lasting results.
  • Client Portal: Our online Client Portal allows you to schedule appointments, upload records, and communicate with our team. Keep your account information accurate and respond promptly to any requests for missing documentation or updates.

Your Responsibilities

In order to provide you and your dog with the best possible Service, you must comply with the responsibilities detailed in this section:

  • Your dog must have up-to-date vaccinations and be free from illness.
  • You must disclose whether your dog has any special needs or behaviors.
  • You must disclose whether your dog has a tendency to bite or act negatively towards individuals or whether they are uncomfortable with new surroundings.
  • You must ensure your dog is healthy enough to participate in all services offered by National Bark unless previous arrangements have been made.

Although we aim to be as accommodating as possible, we reserve the right to deny our services to any individual or any dog for any reason. Please note that if your dog has a history of biting or aggressive behavior, we may deny you use of our Services. If you do not abide by these requirements or if you do not properly disclose your dog’s behaviors to us, we reserve the right to take action against you in the event your dog injures one of our staff members or another dog, or if your dog destroys or damages our property.

Client Portal

You will need to create an account to use our Client Portal. By creating an account, you agree to the terms and conditions detailed in this section.

Through the Client Portal, you can:

  • Schedule or modify appointments for boarding, grooming, and training.
  • Upload and manage pet records, including vaccination and health information.
  • Communicate directly with our team about your pet’s needs or services.
  • Access updates on your pet’s activities and progress while in our care.

Account Registration and Information

To access the Portal, you must create an account using accurate and truthful information, including your name, contact details, and any required pet information (e.g., vaccination records, special needs). You are responsible for maintaining the accuracy of your account information and updating it as necessary. Account Security

You are responsible for safeguarding your account credentials, including your username and password. Do not share your login information with unauthorized users. Any activity performed under your account is your responsibility. We recommend logging out after using public or shared devices. If you suspect unauthorized access to your account, notify us immediately. You are solely responsible for losses resulting from unauthorized use.

Reliance on Information Posted

We strive to provide you the most up to date information for you and your pup to thrive, but we cannot always guarantee it will work for you. The information presented on or through the Services is made available solely for general information purposes. We do not warrant the accuracy, completeness, or usefulness of this information. Any reliance you place on such information is strictly at your own risk. We disclaim all liability and responsibility arising from any reliance placed on such materials by you or any other visitor to the Services or by anyone who may be informed of any of its contents.

Fees and Payment

Payments for our Services are handled via a third-party payment provider. You may be required to purchase or pay a fee to access some of our Services. You agree to provide current, complete, and accurate purchase and account information for all purchases made via the Services. You further agree to promptly update account and payment information, including email address, payment method, and payment card expiration date. We bill you through an online billing account for purchases made via the Client Portal. Sales tax will be added to the price of purchases as deemed required by us. We may change prices at any time. All payments will be made in U.S. dollars.

You agree to pay all charges or fees at the prices then in effect for your purchases, and you authorize us to charge your chosen payment provider for any such amounts upon making your purchase. If your purchase is subject to recurring charges, then you consent to charging your payment method on a recurring basis without requiring your prior approval for each recurring charge, until you notify us of your cancellation.

We reserve the right to correct any errors or mistakes in pricing, even if we have already requested or received payment. We also reserve the right to refuse any order placed through the website.

INDEMNIFICATION

You agree to indemnify National Bark against all losses, liabilities, costs, and expenses (including reasonable attorney fees and court costs), arising from: any breach of these Terms by you or someone using your account; use of the Services, whether properly or improperly, by you or someone using your account; interactions or disputes you have with other users of the Services, including other dog trainers or owners, online or offline; information or content you or someone using your account submit or transmit through the Services; violations of any laws by you; and actions of your dog or any animal under your care, including damages or injuries they cause.

We will not be liable for any loss or damage resulting from: your use of the Services; any malfunction or failure of the Services to operate; or your reliance on information obtained through our Services, or information provided by another user. Limitation Of Liability

To the maximum extent permitted by applicable law and to the extent they are not excluded or disclaimed under these Terms, National Bark and its affiliates, suppliers, and licensors maximum, aggregate liability to you, and your exclusive remedy under these Terms for any and all damages, injuries, and losses arising from any and all claims and causes of action arising out of, based on, resulting from, or in any way related to these Terms, the Services, or the provision of or failure to provide support will be to recover the actual damages you incur based upon reasonable reliance on the product and service, up to one hundred dollars ($100 U.S.D.). The existence of multiple claims or suits under or related to these Terms or the Services will not enlarge or extend the limitation of money damages, which will be your sole and exclusive remedy. The limitation of liability set out in this section does not apply to liability resulting from National Bark’s gross negligence or willful misconduct or death or bodily injury caused by products you purchase through the Services.

Governing Law And Dispute Resolution

All matters relating to the Site and Services and these Terms, and any dispute or claims arising therefrom or related thereto (in each case, including non-contractual disputes or claims), will be governed by and construed in accordance with the internal laws of the State of Texas without giving effect to any choice or conflict of law provision or rule (whether of the State of Texas or any other jurisdiction).

Any legal suit, action, or proceeding arising out of, or related to, these Terms will be instituted exclusively in the federal courts of the United States or the courts of Bexar County, Texas, although we retain the right to bring any suit, action, or proceeding against you for breach of these Terms in your country of residence or any other relevant country. You waive any and all objections to the exercise of jurisdiction over you by such courts and to venue in such courts.
